The penalties of shoplifting vary and are dependent on the type of merchandise that was stolen, its value, and any - if any - previous criminal record. In some cases, shoplifting charges can be reduced down to an infraction but in other cases, large fines - even jail time - can be the result.

Usually, when it is a first time offense and the stolen property value is between $50 and $400, petty theft may be charged as a misdemeanor. This can still result in serious consequences, such as imprisonment for up to 6 months, a fine of up to $400, or both. A second offense can result in felony charges which can result in 16 months in Ohio state prison.

Shoplifting is no longer referred to as petty theft when the stolen property is valued at more than $400. This is known as grand theft and the charges that come with grand theft are far more severe than those that come with petty theft.

In the majority of shoplifting charges, evidence is obtained through witnesses (such as cashiers, security, and other staff) and through the store's security cameras. Additionally, in the majority of shoplifting charges, using excuses such as medication or drug related problems or mental illnesses will not work.
