Misdemeanors are lesser criminal acts that are not as serious as felony charges. One of the main distinctions between misdemeanor penalties and felony penalties is that people found guilty of misdemeanor charges are not sent to penitentiaries like felony convictions. Although misdemeanors are minor offenses, they may also be punishable by jail time.

Classes of Misdemeanors

There are five different classes of misdemeanor offenses categorized by the severity of the misdemeanor and the penalty:

  • Minor Misdemeanor - punishable by a fine up to $150 and no jail-time.
  • Misdemeanor 4 - punishable by a fine up to $250 and jail-time up to 30 days.
  • Misdemeanor 3 - punishable by a fine up to $500 and jail-time up to 60 days.
  • Misdemeanor 2 - punishable by a fine up to $750 and jail-time up to 90 days
  • Misdemeanor 1 – punishable by a fine of $1,000 and jail-time up to 180 days.
  • Misdemeanors can be elevated to a felony. Misdemeanor charges may also be elevated to felony charges if the severity of the crime deems it so. Repeat offenders may be charged with felony charges. However, fines and jail-time may vary slightly state to state.

Common misdemeanor offenses include:

  • Domestic Violence – first offense, a second offense could be charged as a felony.
  • Petty Theft
  • Prostitution
  • Assault
  • Public Intoxication
  • Trespassing
  • Disorderly Conduct
  • Vandalism
  • Reckless Driving
  • Traffic Violations
  • Illegal Gambling
