Manslaughter

Manslaughter is the unlawful killing of another individual without malice or intent on killing.  Manslaughter is different from murder and homicide in that the person charged with the crime had no criminal intent on causing the death of the victim.  According to the most recent Federal Bureau of Investigation (FBI) statistics, there were more than 1.4 million violent crimes reported in 2006.  The FBI estimates that involuntary manslaughter accounted for more than 5% of violent crimes in the nation.

There are two categories of manslaughter: voluntary and involuntary.  Voluntary manslaughter involves the killing of an individual with no prior intent on killing.  Involuntary manslaughter is the negligent cause of another individual’s death.  In both cases, the person accused with manslaughter is responsible for the death.

A proper defense when faced with manslaughter charges is a must.  There are several defenses to manslaughter commonly used by criminal defense attorneys.  These defenses include:

  1. Provocation Defense – the accused was provoked into a course of action that resulted in manslaughter.
  2. Heat of Passion Defense – similar to the provocation defense, the accused is led upon a course of action.
  3. Imperfect Self-defense Defense – this defense posits that the accused acted in self-defense and thusly is not accountable for the death of the victim.
  4. Diminished Responsibility Defense – this defense involves a mental deficiency on the part of the accused.
