Expungement of Criminal Record

Ohio Criminal Defense Lawyer

An expungement is a process in which an entire criminal record is erased. All eligible misdemeanor and felony charges in the state of Ohio may be expunged. A qualified and experienced criminal defense lawyer can file a petition to expunge your criminal record. Once a criminal record is expunged, it is like starting all over on a clean slate because it is like the crime never occurred and like the charges never existed.

To be eligible for an expungement, the following are some of the many qualifications that must be met:

  • Court orders must have been obeyed
  • Defendant must be living an honest life
  • Probation must have been completed successfully or one year must have passed since date of judgement

Expunging a criminal record is vital because having a criminal record can prevent you from doing many things, such as obtaining credit, renting out a residence, voting, obtaining employment and/or job licenses, and more. Many employers do background checks on potential employees and finding out about your criminal past can be the one thing that prevented you from getting that job you wanted.

Keep in mind that not all criminal records can be expunged. Although some felonies and most misdemeanors are eligible for expungement, some crimes - such as those that resulted in a state prison sentence - may not be eligible for an expungement. An Ohio criminal defense lawyer, such as Edward C. Weber, can help determine whether you may or may not be eligible for an expungement of criminal record. A lawyer can also assist in filing a petition for expungement if you qualify. The petition requests that the court sets aside a guilty verdict or reverses a guilty plea. When the petition is approved, the criminal record is officially expunged.

Once a criminal record is expunged, this can't be reversed. Once it is expunged, that's it - it's expunged. However, if new criminal charges occur, expunged convictions can be used against you and you won't be known as a "first time offender".
